1. What MOVA is and who provides it
MOVA is an iPhone app, with its own server, that helps independent professionals who work while traveling to organize their schedule, clients, trips, finances, and safety.
Provided by an independent developer (an individual). Contact by email only: [email protected].
By creating an account or using MOVA, you agree to these Terms and to the Privacy Policy (a separate document, which explains what we do with your data). If you do not agree, do not use the app.
Apple and MOVA. These Terms are between you and MOVA. Apple is not a party to them, is not responsible for the app or its content, has no obligation to provide support for the app, and is not liable for claims about it; Apple and its subsidiaries may enforce these Terms as third-party beneficiaries. The license to use the app follows Apple's standard license agreement (standard EULA), and these Terms apply in addition to it: if there is a conflict about the app license, Apple's agreement prevails.
2. Your account
- Only people over 18. By creating the account you declare that you are 18 or older. The app does not ask for proof of age, but accounts of minors are prohibited; if we discover one, it will be suspended and the data deleted.
- You need an account to use MOVA. You can create one with email and password or with "Sign in with Apple". Accounts are not linked just because the email matches.
- The account is personal and non-transferable. Do not share your login. Whoever works with you (assistant) needs their own account; the app has collaboration for this (section 6).
- You are responsible for keeping your password safe and for everything done on your account while it is protected only by you. Tell support if you suspect misuse.
- You must provide a valid email that you control. Some features (reporting, inviting, and accepting an invitation) require a confirmed email.
- The username (@name) can be changed once every 30 days; the old one stays reserved for 30 days and does not redirect. Some names are reserved by the platform.
3. Permitted use
Use MOVA to organize your own work: your schedule, your clients, your trips, and your finances, and for the collaboration you yourself accept. You are solely responsible for complying with the laws of the place where you work and for your tax obligations. MOVA does not encourage or facilitate illegal activity. The following are prohibited:
- using the app to organize, facilitate, or promote illegal activity, human trafficking, exploitation of any person, or any activity involving minors;
- accessing or trying to access another account's data, circumventing security, or using bots, data scraping, or unauthorized automation;
- using community reports to stalk, defame, threaten, expose, extort, or discriminate against anyone, or for commercial purposes;
- sending content that is offensive, false, misleading, exposes third parties' personal data, or violates third-party rights;
- reselling, sublicensing, or copying the app or any part of it.
MOVA is an organization tool. It does not intermediate, advertise, charge for, or take part in any service you provide to your clients, and has no relationship with your clients.
4. The client data you enter
The clients you register (name, phone, city, notes, photo on your iPhone) are other people's data. By recording them in MOVA:
- you declare that you have a legitimate reason to record and use this data (for example, the professional relationship with the client), under the data protection law that applies to you (in Brazil, the LGPD (Brazil's General Data Protection Law));
- with respect to this data, you are the controller and MOVA is the processor: we store it on your behalf and only so the app works for you, with the exceptions in the Privacy Policy (collaboration you authorize, number lookups you request, and the Owner's administrative access, section 9);
- you are answerable to clients and authorities for what you record and must keep the data correct and delete what is no longer needed;
- do not record sensitive data of clients (health, sexual orientation, sex life, religion, racial origin, political opinion, etc.) in notes, descriptions, or category names, and record only what is necessary for your work; we may remove content that breaks this rule;
- the "Blocked" mark is private to you and is not a report to the community; call and SMS blocking uses a list that stays on your iPhone;
- if you export data (spreadsheet), responsibility for the file and for where it goes is yours.
5. Community reports
The safety module lets you look up whether there are reports about a phone number and submit a report. Reports are about people who generally do not use MOVA and cannot defend themselves inside the app. For this reason the rules below are serious. By using the module, you agree that:
When writing a report:
- write only what you experienced or witnessed and believe to be true; false reports, reports out of revenge, or in exchange for an advantage are prohibited and may create civil and criminal liability for you (for example, for slander, defamation, or insult);
- the comment is required (10 to 300 characters);
- do not write names, addresses, documents, license plates, contacts, social media, photos, or any information that identifies a person; the report is about the phone number and what happened;
- do not write insults, threats, discriminatory content, or sensitive data;
- the photo you attach stays only with you (on your iPhone and in your iCloud) and is never shown to the community; do not attach photos of other people without a basis for doing so;
- once submitted, the report cannot be edited or deleted by you; only moderation removes it. You can ask support to withdraw your report, and moderation decides. Every report is reviewed after 2 years and is removed if it no longer makes sense. It is shown anonymously (comment and date) and remains even if you delete your account;
- internally, MOVA knows which account wrote each report, to fight abuse and for moderation; only the Owner can see the authorship, with each lookup recorded; a court order can compel MOVA to hand over the account data and the access records;
- there are limits: confirmed email, an account at least 7 days old, up to 5 reports per day, one report per number per author, and a limit on lookups per hour and per day.
When looking up:
- a report is another user's word, not proof of anything; MOVA does not verify the truthfulness of reports and is not responsible for decisions you make based on them;
- the lookup happens only when you tap "Look up number"; use it only for your safety at work, never to stalk, expose, or discriminate against anyone;
- the history of your lookups stays only on your iPhone and in your iCloud; MOVA does not keep it.
Moderation, reporting abuse, and blocking: you can mark a report as inappropriate. We may remove reports, hide the reports of a suspended account, and suspend or terminate (permanently block) accounts that violate these rules. Reports removed by court order or for violation do not come back. MOVA's contact channels are in section 14.
If you were reported or are mentioned: write to [email protected], provide the number, and ask for information, correction, or removal. We will confirm that the number is yours, review within 15 days, and remove what is false, offensive, illegal, or contrary to these Terms (details in the Privacy Policy, section 9).
6. Collaboration with assistants
- Collaboration starts from an invitation or request that the professional approves, with permissions she chooses (schedule, amounts and commission, trip, clients, general finances), for a defined time ("this trip only") or with no end date. Schedule, Amounts and commission, and Trip come turned on by default; Your clients and General finances come turned off. The professional can end access at any time. A professional can have several assistants, and an assistant can work for several professionals, with only one collaboration per pair. Invitations and requests expire in 7 days.
- Each person uses their own account and is answerable for what they do on it. What the assistant does is recorded with her name in the action log and on the Activity screen.
- The clients scheduled by the assistant are hers; the professional sees only the name, without phone, unless the assistant shows it on a specific appointment. When access ends, the assistant keeps seeing, read-only, what she herself scheduled, so she can collect her commission.
- If the professional deletes her account, her data is deleted and the assistant stops seeing the schedule and trips; the assistant keeps only a commission statement (date, city, her client, and the amounts), which is hers, so she can collect. If the assistant deletes her account, her clients are deleted and the appointments she scheduled stay on the professional's schedule (Privacy Policy, sections 8 and 13).
- Notes: inside each appointment scheduled through collaboration, the professional and the assistant can leave short notes (the app stores the text, who wrote it, and the time). It is not a chat, it is not for matters outside of work, and section 3 applies: no insults, threats, sensitive data, or unnecessary client data. Notes are deleted with the appointment and on account deletion; the Owner sees them only through account access, with a recorded reason (section 9).
- The commission recorded in the app is an arrangement between you and your assistant. MOVA only calculates and displays it; it does not charge, pay, or guarantee payment. MOVA is not an employer and is not a party to the relationship between professional and assistant.
- Each person is responsible for the data they enter, including client data, under section 4.
7. Safety check-in: no guarantee
The safety check-in is optional. It lets you turn on a timer when going to an appointment and, if you do not confirm "I'm OK" on time, MOVA tries to notify a trusted contact of yours who also uses MOVA and has accepted this function, through the app itself, with the starting location. The starting location is deleted when you confirm.
Read carefully:
- The check-in is NOT an emergency service and does NOT replace the police, ambulance service, fire department, or any emergency service. If you are in danger, call the local emergency number.
- The notice depends on things outside our control: internet signal on your iPhone and your contact's, battery, notification settings, the contact having MOVA installed and open, the accuracy of the device's location, and the operation of Apple's services. The notice may be delayed, may not arrive, or may arrive with an inaccurate location.
- MOVA does not monitor check-ins, does not call anyone other than the contact you chose, and has no response team.
- You are responsible for choosing a contact who can act and for agreeing with them on what to do.
- To the extent permitted by law, MOVA is not liable for damages arising from failure, delay, or inaccuracy of the check-in.
8. Suspension and termination
- You can leave the app at any time and delete your account inside the app (More → Settings). Deletion terminates and deletes your sessions and password reset links, anonymizes your account, and immediately deletes clients, schedule, trips, hotels, finances, notes, profile photo, and report photos from your device and your iCloud; reports become anonymous and the action log is preserved. The record of IP and time of sign-up, login, password change, and report submission is kept for 6 months and deleted automatically, because the law requires it (Marco Civil da Internet (Brazil's Internet Civil Framework), art. 15; details in the Privacy Policy, sections 3.2 and 13). Deletion is immediate and cannot be undone.
- We may suspend or terminate your account, with a recorded reason, if you violate these Terms, use the app for abuse, fraud, or stalking, or if the law requires. On suspension, you are signed out of all devices, you see the message "account suspended, contact support", your reports are hidden, and collaborations are paused; reactivation restores everything. You can contest through support; we will respond within 15 days.
- We may shut down MOVA or a feature of it with 30 days' prior notice, with the possibility for you to export your data beforehand.
9. Administrative access
For security and support, the Owner (the platform's owner) can open any account without asking your permission first and view its data, including clients; afterward, you see on the Activity screen that support accessed it. Changing data only with a ticket you opened. Each opening and each action is recorded and cannot be deleted. The Owner also has a panel where, for a given user, they see the name and phone of the clients she noted in her schedule, so they can act if something happens to her, and at each opening the Owner must write a reason, which is recorded. Regular administrators see the general counts and, for each user, only @name, display name, account status, sign-up date, and last activity, without client data or amounts, without email, phone, or photo. The Owner is a single person, and the panel requires a second verification. The details and limits are in the Privacy Policy, section 11. When creating the account, you accept this access in a prominent box.
10. What is yours and what is ours
- Your data is yours. You give us only the permission necessary to store it, show it to you and to those you authorize, and make the app work. You can export and delete it.
- Where the data is. The server, the database, the profile photo, and the sending of emails are with providers in the United States (Google Cloud, Neon, Cloudflare, and Resend). If you use MOVA in Brazil, your data is sent outside the country, with the safeguards in the Privacy Policy (sections 6 and 7). By creating the account you confirm that you know this.
- The reports you send to the community may be shown to other users anonymously, with no set time limit, under section 5 (you give us permission for this when submitting).
- The app, the MOVA brand, the code, the design, and the texts are ours. You receive a personal, limited, non-exclusive, and revocable license to use the app on your iPhone.
11. No warranties and limitation of liability
- MOVA is provided "as is". We work to make it run well, but we do not guarantee that it will always be available, error-free, or uninterrupted (maintenance, network failures, hosting failures, or Apple failures).
- The app works partially without internet; the server is always the source of truth. Changes made offline may be rejected by the server when the network returns (e.g., a time conflict), and the app tells you.
- The app's calculations (totals, profit, commission, reports) are made from what you type, always by currency and without conversion. They do not replace accounting, tax, or legal advice. You are responsible for your tax and legal obligations.
- MOVA is not liable for: what you or your clients do; the conduct of assistants or other users; the content of reports; data loss caused by a device, iCloud, or Apple account that we do not control (remember that client and report photos and the lookup history stay only with you); failures of the safety check-in (section 7).
- To the maximum extent permitted by law, our liability for any claim related to MOVA is limited to proven direct damages, since the app is free, without removing the rights that consumer law guarantees. This does not apply to willful misconduct, to damages the law does not allow to be limited, or to rights that the Código de Defesa do Consumidor (Brazil's Consumer Protection Code) guarantees, if it applies.
12. Changes to these Terms
We may update these Terms. We will notify you in the app and by email 30 days in advance; continuing to use the app after the indicated date means you accept the new version. Changes that reduce your rights or expand the use of your data require acceptance inside the app. Previous versions are available upon request to support.
13. Governing law and venue
These Terms are governed by Brazilian law. For consumers in Brazil, the courts of the consumer's home are competent (Consumer Protection Code). For other users, the law of the country where they live applies when local law requires it; otherwise Brazilian law applies. For users outside Brazil, the consumer protection and privacy laws of the place where they live (for example, in the United States, the laws of the state where they live) may continue to apply, despite this clause. In the first version MOVA is offered only in Brazil and the United States, even though the app has five languages.
14. Contact
- Support: Help screen in the app and email [email protected].
